A Temporary Event Notice is to be used to authorise licensable
activities (regulated entertainment, the sale or supply of alcohol
and late night refreshment) lasting not more than 4 days for 499
people or less.
The following information is applicable for premises in the
Waveney District Council area.
There are restrictions on numbers of TENs possible for an
individual/premises and these are explained in the notes on the TEN
form.
The form should be submitted to the Licensing Team at least 10
working days before the event. However it would be helpful if you
could give us as much notice as possible for the event as the
police or consultees, may object to the event.
If the police do make an objection there may have to be a hearing
and obviously it would be better for everyone concerned if this
took place in good time before the event.
The local licensing authority must hold a hearing if an
objection notice is served. They may issue a counter notice if it
considers it necessary for the promotion of crime prevention
objective. A decision must be made at least 24 hours before the
beginning of the event.
A police chief may modify the TEN with the consent of the
premises user. In such a case an objection notice will be deemed to
have been withdrawn.
Counter notices may be provided by the licensing authority if
the number of permitted TENs has been exceeded.
The original application and 1 copy, plus the fee of £21 for each
event (cheques to be made payable to Waveney District Council)
should be sent to the Licensing Team, Waveney District Council, PO
Box 190, Lowestoft, NR32 1WX.
An additional copy of the application form should be sent to the
police at the following address; Duty Inspector, Lowestoft
Administration Office, Suffolk Constabulary, Police Station, Old
Nelson Street, Lowestoft, Suffolk, NR32 1PE. The envelope should be
clearly marked “Temporary Event Notice Application” and they may be
submitted any time Monday to Thursday but before mid-day on
Friday.
If no objections are received from the police, we will stamp and
sign the copy of the application and return it to you as
acknowledgement of receipt of the TEN. This should be kept safely
and should either be prominently displayed on the premises during
the event, or be kept in the custody of the premises user or a
nominated person, and a notice displayed at the premises to this
effect.
Will Tacit Consent Apply?
Tacit consent applies to a Temporary Event notice if no relevant
representations are made during a period of 48 hours after the
notice has been given to the Police. This target date is known as
the 'last date for representation.' The notice will be deemed to
have drrect after the last date for representation. You will be
informed within 7 working days after the last date for
representation if your notice is effective.
If relevant representations are made within 48 hours a valid notice
being received tacit consent does not apply and a public hearing
must be held to determine your application. The public hearing
will be held within 7 working days after the last date for
representation. The hearing date may be extended beyond 7
working days if the Licensing Authority considers it is in the
public interest to do so.
Failed Application Redress
Please contact your Local Authority in the first instance.
If a counter notice is given in relation to an objection notice
the applicant may appeal against the decision. Appeals must be made
to the local Magistrates' court within 21 days. An appeal may not
be brought later than five working days from the day of the planned
event.
Licence Holder Redress
Please contact your Local Authority in the first instance.
Consumer Complaint
We would always advise that in the event of a complaint the first
contact is made with the trader by you - preferably in the form a
letter (with proof of delivery). If that has not worked, if you are
located in the UK, Consumer Direct will give you advice. From
outside the UK contact the UK European Consumer Centre .
Other Redress
If a licensing authority decides not to issue a counter notice in
relation to an objection notice the chief police officer can appeal
the decision. Appeals must be made to the local Magistrates' court
within 21 days. An appeal may not be brought later than five
working days from the day of the planned event.
