Council Tax Reductions for the Severely Mentally Impaired


This section is useful if you live with someone who is severely mentally impaired, if you deal with the affairs of someone who is severely mentally impaired, or if you are (or think you may be) severely mentally impaired yourself.

People who are severely mentally impaired are mentioned under Discounts and Disregards, and also under Exemptions (Class U).

Definition

There are two conditions that must be met in order for a person to be classed as severely mentally impaired.

Firstly, a medical practitioner must state in a certificate that the person is severely mentally impaired. For the purposes of this relief, a person is severely mentally impaired if he has a severe impairment of intelligence and social functioning (however caused) which appears to be permanent.

The Department of Health issued a circular to medical practitioners in 1992, giving information on this matter. Practioners should refer to this document if they require guidance

Secondly, the person must be entitled to a qualifying benefit. These are:

  • Invalidity pension
  • Attendance allowance
  • Severe disablement allowance
  • The care component of a disability living allowance at the higher or middle rate
  • An increase in the disablement pension
  • Disability working allowance
  • Unemployability supplement
  • Constant attendance allowance under articles 14, 18 of the Personal Injuries Scheme or the Services pensions Order 1983
  • Increase in job Seekers Allowance on the grounds of the applicants incapacity for work

Liability

If a severely mentally impaired person is jointly liable with at least one other person who is not severely mentally impaired, then the person who is severely mentally impaired is not liable.

If a severely mentally impaired person is the sole liable person at an address or if all of the liable persons are severely mentally impaired, then they will remain liable.
