Consultation Overview
Waveney
District Council is signed up to the Cabinet Office “Enforcement
Concordat” which sets out the key principles of fair, transparent,
proportionate and reasonable enforcement. The detailed application
of this aproach to enforcement activities carried out by the
Environmental Health team is described by the Environmental Health
Enforcement Policy, adopted in 2005.
Following changes in guidance and legislation, it has become
necessary to amend this policy to include references to enforcement
action taken in respect of children and young people and also in
cases where the team find themselves in the position where they are
the enforceing authority for activities carried out by the
Council.

Who is
consulting?

And why?
Guidance published by DEFRA requires the Council to consult with
relevant agencies on the application of its enforcement policy as
it applies to children and young people.
Guidance issued by the Food Standards Agency requires the Council
to amend its policy to accommodate circumstances where it is the
body responsible for activities that are subject to its own
enforcement.
Local businesses and private individuals may be the subject of
enforcement activities when the Council carries out its regulatory
functions in respect of pollution control, food hygeine and health
and safety legislation.
